Welcome to Behavioral Analyst Prep ("we," "us," or "our"). By accessing or using the website located at behavioralanalystprep.com (the "Site") or creating an account, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the Site.

If you do not agree to these Terms, do not access or use the Site.

⚠️ Behavioral Analyst Prep is not affiliated with, endorsed by, or sponsored by the Behavior Analyst Certification Board®, Inc. (BACB®). Use of this Site does not guarantee passing any certification examination.

1. Description of Service

Behavioral Analyst Prep provides an online platform offering practice questions and study materials designed to help candidates prepare for behavior analyst certification examinations. Our content is independently developed and aligned to the publicly available BCBA Test Content Outline (6th ed.) published by the BACB®.

2. No Guarantee of Results

USE OF THIS SITE DOES NOT GUARANTEE THAT YOU WILL PASS ANY CERTIFICATION EXAMINATION. We make no representations or warranties regarding exam outcomes, employment prospects, or any other results arising from your use of our materials. All practice questions are independently developed study aids and are not actual examination questions.

Certification examinations are administered solely by the Behavior Analyst Certification Board®, Inc. We have no control over, and make no representations about, the content, format, or scoring of any examination.

3. Not Affiliated with the BACB®

Behavioral Analyst Prep is an independent, privately owned study platform. We are not affiliated with, endorsed by, approved by, or connected to the Behavior Analyst Certification Board®, Inc. (BACB®) in any way. BACB®, BCBA®, BCaBA®, and RBT® are registered trademarks of the Behavior Analyst Certification Board, Inc. All rights reserved by their respective owners.

4. Accounts and Registration

To access certain features of the Site, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain the security of your password and account
Notify us immediately of any unauthorized use of your account
Not share your account credentials with any other person
Be responsible for all activity that occurs under your account

We reserve the right to terminate accounts that we believe are being shared or used in violation of these Terms.

5. Subscriptions and Billing

Behavioral Analyst Prep offers a free trial and a paid monthly subscription.

Free Trial: New accounts receive access to a fixed set of 20 sample questions at no charge.
Monthly Subscription: Full access to all content is available for $19.00 per month, billed monthly.
Billing: Subscription fees are billed in advance on a monthly basis. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial months.
Price Changes: We reserve the right to change subscription pricing with 30 days' notice.

6. Acceptable Use

You agree not to:

Share, reproduce, distribute, or publish any practice questions or content from the Site
Use automated tools, bots, or scrapers to access or collect content from the Site
Attempt to reverse engineer, decompile, or extract our question database
Use the Site for any unlawful purpose or in violation of any applicable law
Misrepresent your identity or impersonate any person or entity
Interfere with or disrupt the integrity or performance of the Site

7. Intellectual Property

All content on this Site, including but not limited to practice questions, explanations, text, graphics, and software, is owned by Behavioral Analyst Prep or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial study purposes only.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BEHAVIORAL ANALYST PREP AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ITS CONTENT.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.

9. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Bexar County, Texas.
